These terms

These terms cover your use of matihub.com and everything served under it. The site is operated by Cortex Solutions LLC, a [state of formation — e.g. Delaware] limited liability company, trading as MATIHUB ([business mailing address — street, city, state, ZIP, USA]).

By using the site you accept them. If you do not, stop using it — that is the whole of the bargain, and there is nothing else you are agreeing to by being here.

What you may do

Read it. Link to it. Quote a short passage with attribution. Send it to someone. Take a screenshot for a review or an article. None of that needs permission.

What needs permission: copying the site or a substantial part of it, republishing its text, design, artwork, sound or code, reusing any of it in your own product or client work, or using it as training data for a machine-learning system. Ask first and you will usually get a yes.

What you may not do

Do not try to gain access to anything that is not open to you, to any account, server or system behind this site, or to a private preview you were not given. Do not probe, scan or attack the infrastructure, and do not attempt to defeat the password on a client preview.

Do not scrape the site at a rate that degrades it for anyone else, do not misrepresent yourself as the studio or as one of its clients, and do not use any address published here to send unsolicited commercial mail.

Genuine, good-faith security research is welcome. Tell us what you found before you tell anyone else and we will work with you.

Nothing here is an offer

The studio sells software development, design and strategy, and you are welcome to write and ask about any of it. But the pages describing what it does are a description, not a contract. Prices, timelines, availability and capability shown or implied here create no obligation and may change without notice.

Contacting us does not create a client relationship and does not oblige either side to anything. Work is agreed in a written proposal signed by both sides. Where that proposal and this site disagree, the proposal wins; where these terms and a signed client agreement disagree, the client agreement wins for that client.

Private client previews

This site is public. From time to time the studio publishes a project here behind a password so a client can review it before it is released; if you have not been sent such a link, there is nothing on this site you need a password for.

If you have been given one, the link, the password and everything behind them are confidential: they are unreleased work, frequently subject to a separate non-disclosure agreement, and not to be shared, reposted or shown outside the people who need to see them. Access is granted for review and may be withdrawn at any time. Keep your credentials to yourself and tell us immediately if you think they have leaked.

Music

Jump, Get Lost plays on this site by permission of its owner, which is us. It is provided for listening here, as part of the page. It is not a download and it is not licensed for reuse — not in video, not in a podcast, not in a commercial, not in another website. If you want to use it, write and ask.

Do not attempt to circumvent how it is delivered in order to obtain a copy.

Things we link to

This site links to other people's sites, and it serves some client projects from the clients' own deployments at matihub.com addresses. We do not control any of that. We are not responsible for their content, their accuracy, their availability or their terms, and using them is between you and them.

Availability

We would like the site to be up all the time and it usually is, but it is provided as it is and as it happens to be available. We do not promise it will be uninterrupted, free of faults, free of malicious code, or compatible with your particular browser or device, and we may change, move or withdraw any part of it at any time without notice.

Disclaimers

To the fullest extent the law allows, the site and its content are provided without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

Nothing on this site is professional advice for your situation. Do not make a decision that matters on the strength of a portfolio page — talk to us, or to someone qualified in the relevant field.

Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Where you have consumer rights that cannot be waived under the law of your own country or state, nothing here waives them.

Subject to that, and to the fullest extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential loss, for loss of profit, revenue, business, goodwill or data, or for loss arising from your reliance on anything published here, however it arises. Our total liability in connection with your use of this site is limited to one hundred US dollars ($100).

This limit applies to the website. It does not apply to work performed under a signed client agreement, which carries its own liability terms.

Privacy

How this site handles data — which is: barely at all — is set out in the privacy page, which forms part of these terms.

Changes

We may revise these terms. The version published here is the one that applies, and the date at the top tells you when it last changed. Continuing to use the site after a change means you accept the revised version; if you do not, stop using the site.

If part of this does not hold

If any provision is found invalid or unenforceable, it is severed and the remainder continues in force. Not enforcing something on one occasion does not waive the right to enforce it later.

Governing law

These terms, and any dispute arising out of them or out of your use of this site, are governed by the laws of the State of [state of formation — e.g. Delaware] and the federal law of the United States, without regard to conflict-of-law rules. The state and federal courts located in that state have exclusive jurisdiction, and both sides consent to their jurisdiction and venue.

If you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory laws of your own country, or of your right to bring proceedings there.
